Summary of the new criteria for ‘Demerit Points’ implementation starting from January 9, 2023.

If you don’t want to receive ‘Demerit Points’

Option 1: “Immediate Deduction of Points upon Violation”

Deduct 1 point for each of the following:

– Using a phone while driving
– Not wearing a helmet (for motorcycle riders)
– Not fastening the seatbelt
– Speeding
– Driving on sidewalks
– Not yielding to pedestrians at crosswalks
– Not yielding to emergency vehicles
– Driving aggressively or recklessly
– Driving without visible license plates or obscured plates
– Not displaying tax stickers

Deduct 2 points for each of the following:

– Running a traffic light
– Reversing without caution
– Driving while under license suspension or revocation

Deduct 3 points for each of the following:

– Driving while physically unfit
– Reckless driving behavior
– Hit-and-run accident

Deduct 4 points for each of the following:

– Driving under the influence of alcohol
– Driving under the influence of drugs
– Street racing without permission
– Disregarding the safety of others while driving

For Type 2, “Deducting points for failure to pay fines according to the ticket”: For each outstanding ticket, deduct 1 point if the fine is not paid.

– Disobeying traffic signals
– Parking in prohibited areas
– Failure to present a driver’s license while driving
– Driving not close to the left side of the road

Initial points: 12 points

If a driver’s points reach 0, their driver’s license will be suspended, prohibiting them from driving all types of vehicles for 90 days. If they violate this suspension, they may face imprisonment for up to 3 months, a fine of up to 10,000 baht, or both.

For a third suspension within 3 years, the driver may face a suspension of more than 90 days.

For a fourth suspension, immediate revocation of the driver’s license may be considered.

Criteria for regaining points:

– Points deducted for each offense will be reinstated after one year from the date of the offense, except in cases where the points reach 0. In such cases, points will be reinstated after the specified time.
– Upon completion of training with the Department of Land Transport according to the criteria and conditions, all 12 points will be reinstated.
